DATA PROTECTION-CLAMPBATTLE

(1) AllLite - the digital business division of ALLMATIC- Jakob Spannsysteme GmbH, represented by the Managing Director Bernhard Rösch, Jägermühle 10, 87647 Unterthingau (referred to in the following as AllLite) is holding a competition at the EMO trade fair in Hannover. Participation in this competition, implementation and processing are based on the following conditions.

(2) By participating in this competition, the competitor accepts these conditions of participation.

(1) All persons who have unlimited capacity to conduct business and who are 18 years or over at the time of participation are eligible to take part.

(2) Minors under 14 years are not permitted to participate according to the Bavarian “Gewinnspielsatzung” (prize competition statute). Should minors under 14 years nevertheless participate and win, we point out that we cannot award prizes to them.

(1) All employees of AllLite and their relatives and family members are excluded from participating in the competition. Commercial users and non-natural persons, in particular the so-called “Gewinnspiel-Eintragsservice” (competition entry service), competition syndicates or automated services are also excluded.

(2) Participants who infringe the conditions of participation or have given false information during their participation or have fraudulently gained an advantage can be excluded from the competition. In addition, AllLite also reserves the right to subsequently withdraw the prizes from unauthorised participants and demand their return.

(1) Participation is free of charge. The purchase of products or the use of services of AllLite is not a condition for participation in the competition and has no influence on the result of the competition.

(2) Participation is only possible at the trade fair. Participation is possible by participants taking part in the ClampBattle and winning the individual game. The time required is measured. The winner is placed according to the time on a high score list. The first 30 places at the end of the trade fair day receive the prizes specified in paragraph 3.

(3) Places 1-30 are awarded as follows:

1st place: Sport sunglasses with built-in camera

Places 2-30: Bluetooth loudspeakers

(4) Prizes are awarded on each trade fair day in accordance with the paragraphs above. The deadline for entries on each day is 4.00 p.m.

(5) Only one prize can be awarded per participant.

(1) The winner is determined subject to authorised participation according to clauses II to IV. The winners are determined on each trade fair day. If the winners are present, the prizes are personally awarded at the Allmatic booth at 4.30 p.m. If the winner from EU countries does not come on this day, he or she will be notified by e-mail within a week after entries close. The prize will then be sent to the winner by post. A delivery to non-EU countries is excluded.  

(2) No liability is assumed for the announcement of the winner.

(4) If circumstances arise for which we are not responsible, the individual winner accepts an appropriate replacement prize. Such circumstances beyond our control are in particular those for which the sponsors of the prizes are responsible.

§ 1 Information on the collection of personal data

(1) In the following, we inform you of the collection of personal data when you participate in our competition. Personal data are all data which are personally related to you, e.g. name, address, e-mail address.

(2) The responsible entity as per Art. 4 Paragraph (7) EU General Data Protection Regulation (GDPR) is ALLMATIC-Jakob Spannsysteme GmbH, Jägermühle 10, 87647 Unterthingau, www.alllite.de.

(3) If we use appointed service providers for individual functions of our products or wish to use your data for commercial purposes, we will inform you below in detail of the individual processes and specify the defined criteria of the storage period.

§ 2 Your rights

(1) You have the following rights with respect to us concerning your personal data:

– Right to information;

– Right to correction or deletion;

– Right to restriction of processing;

– Right to objection to processing;

– Right to data transferability.

(2) You also have the right to complain to a data protection supervisory body with regard to the processing of your personal data by us.

§ 3 Collection of personal data for our competition

(1) For participation in the competition and to announce the prize, we collect the following data:

– first name and surname

– address

– age

– e-mail address

– player ID

This is mandatory information. It is used for the purposes of implementation and processing of the competition and to check correctness of the data. The legal basis for this is Art. 6 Paragraph 1 p. 1 lit. b) and f) GDPR. The legal basis for processing the voluntary data is Art. 6 Paragraph 1 p. 1 lit. a) GDPR.

(2) On participation in the competition, the participant consents to his or her full name being published in the internet on the website of AllLite for the purpose of reporting on the prize. The legitimate interest of AllLite lies in assessment of the competition in the media and mentioning the partners who provide the prizes. This is also used to acquire partners for prizes of further competitions in future. The legal basis for this is Art. 6 Paragraph 1 lit. f) GDPR.

(3) AllLite is entitled to forward the data to third parties who are commissioned with the implementation and processing of the competition, in particular delivery services and the partners who provide the prizes for the competition, for the individual purpose (delivery, claiming the prize). The legal basis for this is Art. 6 Paragraph 1 lit. f) GDPR.

(4) The data are deleted as soon as they are no longer required to achieve the purpose of their collection. The data are thus deleted as soon as the winner has received the prize, the data have been sent to the partners of the competition and the winners have been published.

(5) You can declare your revocation with regard to the voluntary data by sending us an e-mail to info@alllite.de.

(1) Neither the promotion and the contents thus determined, made available or produced, nor the competition documents and their contents in their entirety or partly, may be used commercially or in business transactions. Neither use of the promotion nor the contents thus communicated or produced nor access to the websites or contents may be offered to third parties against payment nor in the context of sponsored services. The contents of the competition themselves may not be sold or kept in stock for sale or any other commercial use.

(2) Participation in the competition and the contents thus communicated or produced does not entail becoming an employee or supplier of AllLite.

(1) AllLite is not liable for a lost or damaged prize or a prize which is received late. In particular, warranty claims are excluded in the case of material and / or legal defects.

(2) Claims for compensation against xxx are excluded independently of the legal grounds, unless AllLite, its legal representatives or vicarious agents have acted with intent or gross negligence. AllLite is only liable for simple negligence if an essential contractual obligation to achieve the contractual purpose has been infringed by AllLite, its legal representatives or executives or vicarious agents.

(3) This exclusion of liability does not apply in cases of claims for compensation resulting from loss of life or limb or health or acceptance of a quality guarantee or fraudulent concealment of defects on the part of AllLite.

(4) Insofar as AllLite is liable for simple negligence, the compensation claim is restricted to the foreseeable damage typical for the contract.

(5) The exclusion of liability also applies to the companies associated with AllLite and to personal liability od employees, workers, staff, representatives, shareholders and vicarious agents of AllLite and / or the companies associated with AllLite.

AllLite can interrupt or terminate the competition at any time without notice and without having to give reasons. AllLite can assert this right in particular when orderly implementation of the competition may no longer be possible for technical reasons (e.g. computer virus, manipulation) or legal reasons.

(1) Legal recourse is excluded.

(2) These conditions of participation and all legal relationships resulting therefrom are exclusively subject to the laws of the Federal Republic of Germany insofar as no other exclusive place of jurisdiction is prescribed by law.

(3) Should individual regulations of these conditions of participation be or become invalid, the other conditions of participation remain valid.
